Black-Liner GmbH

§ 1 Offer and Conclusion of Contract

The offers of Black-Liner GmbH are non-binding.
The purchaser (client) may place his order orally or in writing. The contract is concluded upon the written confirmation of the order by Black-Liner GmbH.

 

§ 2 Scope of Services

The provisions in the written confirmation shall be decisive for the scope of contractual services.
The services include — within the scope defined by the written confirmation — the provision of a vehicle of the agreed type with driver and the performance of the transport.

The agreed service does not include supervision of passengers, supervision of items that the customer or one of his passengers leaves in the passenger compartment of the vehicle, or supervision of baggage, in particular during loading/unloading.

 

§ 3 Price and Payment

The price agreed upon at the time of contracting and the negotiated payment plan or payment terms apply.

Reservations made in writing or orally are valid for a maximum of three weeks. If no booking is made by then, the reservation becomes invalid and is automatically canceled. The purchaser thus has no claim to the reservation.

For hygienic reasons, we change the bed linen after 14 days. We therefore charge a flat rate of €3.90 per bed. This amount must be paid in cash to the driver.

 

§ 4 Cancellation and Withdrawal by the Purchaser

If the customer cancels the contract before the end of the trip or does not use the vehicle, no exemption from the obligation to pay arises, unless the cancellation is due to a circumstance for which Black-Liner GmbH is responsible.
Black-Liner GmbH must offset saved expenses and benefits from an alternative deployment of the vehicle.

In these cases the purchaser must pay the following flat rates:

  • For non-use up to 30 days before departure: 10 %

  • For non-use up to 20 days before departure: 25 %

  • For non-use from the 10th day before departure: 50 %

  •  

Half or full payment must be made 14 days before the start of the tour.
Otherwise we reserve the right not to provide the vehicle.

Compensation may be higher or lower if Black-Liner GmbH proves a greater damage or the purchaser proves a lower damage.

 

Invoice issuance:
Route portions in Germany are subject to tax.
Foreign portions are subject to 0 % VAT.
Domestic: 19 % VAT.

In our offers, the taxable domestic portion (relating to all kilometers traveled in Germany) is stated plus 19 % VAT.
Foreign portions are tax-exempt.

 

§ 5 Cancellation and Withdrawal by the Carrier

Black-Liner GmbH and the client may cancel the contract if there is an important reason beyond their control that makes continuation of the transport unreasonable — in particular in cases of force majeure such as war, unrest, epidemics, severely hazardous weather or road conditions, border closures or roadblocks.

In case of vehicle breakdown without fault, especially due to accidents or technical defects despite proper maintenance, Black-Liner GmbH is not obliged to provide an equivalent replacement vehicle.
If no such vehicle is available due to these circumstances or lack of rental availability, Black-Liner GmbH and the client are released from their performance obligations.

In both cases, Black-Liner GmbH must carry out the necessary organizational handling measures during the transport in coordination with the client.
For services rendered, Black-Liner GmbH receives remuneration at its usual rates. Additional costs incurred are to be borne by the client.

 

§ 6 Liability

Black-Liner GmbH is liable for property damage under the scope of § 23 of the Passenger Transport Act (Personsbeförderungsgesetz) only if the damage per person exceeds €1,000 and is not due to intent or gross negligence on its part.

Otherwise the liability for contractual obligations — regardless of legal basis — is limited to three times the transport price, unless intent or gross negligence exists.
This limitation does not affect liability for negligent violation of essential contractual obligations.

Tortious claims that arise outside the contractual relationship between Black-Liner GmbH and the purchaser remain unaffected.
Any further liability of Black-Liner GmbH is excluded, with reference to § 2 para. 3.
The operator may exclude liability for property damage to any transported person only to the extent that the damage exceeds €1,000 and is not caused by intent or gross negligence.

 

§ 7 Jurisdiction

Jurisdiction is Neu-Ulm, provided the purchaser is a merchant, a legal entity under public law, or public special fund.

 

§ 8 Applicable Law

Laws exist to be followed — and we abide by that.
It is important that our drivers are well-rested and fit to perform their job. Thus we fulfill our transport service — we place great value on that.

 

§ 9 Driver / Co-Driver

Number of required beds:
Main drivers have their own sleeping cabin in the bus.
Co-drivers must be accommodated in the available beds.

If the co-driver has no sleeping possibility in the vehicle, a hotel room must be provided. This is about passenger safety, ensuring our drivers are rested.
Therefore please consider for how many band & crew members the bus is booked.

The co-driver supports the main driver in his driving and work tasks and is to be regarded as a crew member for the entire tour. He requires — like other co-drivers — a bed in the vehicle to fulfill his rest periods.

Only as many persons are transported as there are seats and beds available and registered in the vehicle. If this is not complied with, Black-Liner GmbH may refuse or even cancel the transport under § 42 PBefG.

Daily meals must always be ensured for both drivers.

The driver and the co-driver are entitled to a minimum €15.00 tipping per day. This tip is to be paid in cash to the drivers at the end of the tour.

If the co-driver cannot stay in the vehicle, the production must bear hotel costs. This may be paid in cash or by providing a booking receipt for the accommodation during the deployment.

The law of the Federal Republic of Germany applies.

As carrier, we have house rights over our vehicles.
The instructions of the staff assigned to traffic control and traffic regulations of Black-Liner GmbH must be strictly followed, and displayed information must be observed.

 

§ 10 Completeness of Persons

At vehicle departure, the traveling persons or the tour manager must check the completeness of the persons.
If one or more persons are missing, who are not on board, that person is responsible to reach the provided vehicle again. The cost is borne by the purchaser / organizer.

 

§ 11 Conditions of Carriage

Persons excluded from transport:
(1) Persons who pose a danger to safety or order of operations or to the passengers are excluded from transport. Particularly excluded are:

  • Persons who show or commit violence.

The operating staff decides on exclusion. Operating staff in these transport conditions are all persons assigned by the carrier to fulfill its tasks.
They exercise house rights on behalf of the carrier.

(2) On request of operating staff, persons must leave not only the vehicle but also operating facilities. The lawful exclusion from transport or lawful ejection of a person does not give rise to a claim for damages.

(3) Smoking is prohibited in the upper as well as in the lower deck of the vehicle, as we want to offer a clean and well-kept vehicle.

(4) Stealing tools, crockery or other accessories required for the operation of the vehicle is prohibited.

(5) The purchaser bears full costs of repair for internal or external damage to the vehicle or trailer.

We expressly point out that our drivers hold house rights and may refuse transport under § 42 PBefG for persons who do not follow rules.

 

§ 12 Routing / Personal Matters

Please leave route planning, assessment and route guidance to our drivers — they are professionals and navigate the large vehicle daily through rural and urban areas.
Please refrain from Google Maps comparisons, as speed, tolls, vehicle weight and size require entirely different planning. Our buses are equipped with GPS systems customized to these vehicle types.

Extra kilometers not included in the offer will be charged later (e.g. deviation from route for drop-off at station, hotel, rest stops, cities or other places).

 

§ 13 Stationary Operation of Buses at Festivals, Clubs, Halls, Event Locations and Off-days

All buses are fully air-conditioned and have fixed-line air conditioning / parking heating.
At the event location as well as on off-days, a three-phase 32-ampere power supply is required. Without this, the air conditioning / parking heating cannot be operated.
Thus, persons or drivers may not remain on board. In this case, the production must provide hotel rooms for drivers and co-drivers.

The bus power supply is 220–240 V and available both during driving and standstill.

We offer baggage loading and unloading service. Depending on quantity, please note that our drivers may not always provide this service after long drives.

The prices agreed at the time of contract and the negotiated payment plan apply.
